Notarial Translation

Which law applies to the notarization of translations?

In Vietnam, according to the provisions in Clause 1, Article 61 of the 2014 Notary Law:

1. The translation and notarization of documents from Vietnamese to a foreign language or from a foreign language to Vietnamese must be carried out by translators who are collaborators of the notary public organization. These collaborators must hold a bachelor’s degree in foreign languages or another field that demonstrates proficiency in the foreign language used. They are responsible to the notary public organization for the accuracy and appropriateness of the translated content they produce.

2. The notary public receives the original documents, verifies them, and hands them over to the translator who is a collaborator of their organization. The translator must sign each page of the translation before the notary public records the notarization statement and signs each page of the translation. Each page of the translation must bear the stamp “Translation” in the blank space on the upper right side; the translation must be accompanied by a copy of the original document and sealed with a crossover stamp.

3. The notary’s certification for the translation must clearly state the date, location of notarization, full name of the notary, name of the notary organization; full name of the interpreter; certification that the signature in the translation is that of the interpreter; certification that the content of the translation is accurate, does not violate any laws, and is in accordance with social ethics; and include the signature of the notary and the seal of the notary organization.

  1. The notary public shall not receive and notarize the translation in the following cases:
  2. a) The notary public knows or should know that the original document is issued improperly or is not valid; it is a forged original document;
  3. b) The document requested for translation has been erased, altered, added, subtracted, or damaged, making its content unclear;
  4. c) The document requested for translation is classified as a state secret; the document is prohibited from dissemination according to legal regulations.
  5. The Minister of Justice provides detailed regulations on the notary public’s statement form for the translation.

Which agency has the authority to notarize translations?

Based on the aforementioned provision, individuals proficient in the language can translate documents themselves to serve their own records. However, notarization cannot be carried out without a foreign language university degree and registration with the competent authorities. Among these requirements, the notarization of the translated document must include the original document, which should bear a legitimate seal for cross-referencing related paperwork. Furthermore, starting from the year 2014 until now, the state has regulated that authorized notarization agencies, including private notary offices or notary departments under the District or Provincial Department of Justice, have equal legal validity. Additionally, the translation should clearly indicate the full name and signature of the responsible translator to ensure the accuracy of the content in comparison to the original document, accompanied by the authentication signature from the notary public.

Therefore, translation and notarization are two independent activities but have a collaborative relationship to ensure the legal integrity of documents.
